About
The Public Rights-of-Way ADA Compliance Program (the Program) exists to improve the accessibility of existing pedestrian facilities including sidewalks and street crossings and to ensure constructed pedestrian facilities meet the accessibility requirements adopted by Anne Arundel County. Program authority is limited to pedestrian facilities along county owned and/or maintained roadways where public access is protected by rights-of-way (ROW), and does not extend to privately owned or even county owned parcels. The objective of the Program is to reach full compliance with accessibility requirements and to remove all barriers to accessibility within the county ROW.
The scope of the Program includes the establishment of compliance criteria, development of construction standards and details, inventory and evaluation of existing pedestrian facilities within the ROW for ADA compliance, and the prioritization and programmatic removal of barriers to accessibility within the county ROW. Implementation of the program follows Anne Arundel County’s ADA Self Evaluation and Transition Plan for the Public Rights-of-Way.
Transition Plan
Title II of the Americans with Disabilities Act (ADA) applies to public entities, and requires Anne Arundel County to develop a transition plan as an agency with more than 50 employees. The Infrastructure Management Division, within the Bureau of Highways, Department of Public Works, is responsible for the development and implementation of the Transition Plan for the county ROW. The Transition Plan includes an inventory of barriers to accessibility, a detailed description of methods used to eliminate barriers, an implementation plan and schedule, and the identification of the individual responsible for implementing the plan. The Self Evaluation and Transition Plan has been developed over several years and will continue to evolve as progress is made toward full compliance of pedestrian facilities within the county ROW.
Program
The Program is executed primarily via a dedicated multi-year capital project: H566600 ADA ROW Compliance. This capital project funds accessibility upgrades within the ROW including curb ramps installations or upgrades, existing sidewalk upgrades, driveway entrance upgrades, and installation of Accessible Pedestrian Signal (APS) equipment at signalized intersection crossings. Upgrades are programmed in priority order or in response to citizen requests. In addition to this dedicated capital project, numerous other capital projects fund accessibility improvements including those triggered by the Pavement Management Program.
Public Requests
The Infrastructure Management Division responds to special requests for accessibility upgrades within the public ROW by programming reasonable accommodations including retrofits to a desired accessible route and removal of barriers within ninety (90) days of acknowledgement under the aforementioned H566600 capital project as funding allows.
